It has come to my attention, through your media blog, that ABSOLUTE UNTRUTHS HAVE BEEN PUBLISHED TO THE MEDIA BY MICHAEL DOWEARY, THE ACT 47 RECEIVER FOR THE CITY OF CHESTER, IN ONE OF HIS “RECEIVER UPDATES” WITHOUT EVERY CONSULTING WITH THE STORMWATER AUTHORITY FOR VERIFICATION!
According to Doweary’s “update report”, which was never forwarded to the Stormwater Authority, a complete mischaracterization of a “potential” deal with the Philadelphia Union was published. In his report, Doweary stated that the Authority offered the Union a “reduction” in fees if the Union sold a property to the Authority for a potential development project of a travel sports facility complex and that the Authority was additionally paying for it with bonding.
THE AUTHORITY HAS NEVER OFFERED ANY REDUCTION IN FEES TO ANY COMMERCIAL PROPERTY OWNER WITHOUT DOCUMENTED PROOF OF STORMWATER MIGATION BY THE PROPERTY OWNER OR THAT THE PROPERTY HAS A D.E.P. LICENSE TO EMIT STORMWATER…THE AUTHORITY ONLY OFFERED A REDUCTION IN WHAT WAS OWED TO US BY THE UNION, TOTALING OVER $300,000, IN EXCHANGE FOR A CONVEYANCE OF LAND FROM THE UNION TO THE AUTHORITY.
It would be a violation of the Stormwater Authority’s mandate, for the Authority to reduce any property fees of a commercial property owner in exchange for anything of value. Additionally, under the Pennsylvania Municipal Authorities Act, any Authority can bond for the development of projects as it is specifically mandated under the Act.
The Chester Stormwater Authority is demanding that this blatant falsehood, described above, be immediately retracted by Mr. Doweary by official publishing or we will seek legal action against him personally and see that he is removed as receiver….It is also the Authority’s position that Mr. Doweary has absolutely no Stormwater Authority oversite whatsoever and if he believes he does, we would like that in writing, with the legal authority he believes he possesses, so we may file the appropriate injunctive action against the receiver to enjoin Mr. Doweary from any actions he might take….
The fact that Doweary and your blog would publish such nonsense and untruths without conferring with the Authority for confirmation, is insulting!
